These Terms of Service ("Terms") govern your use of the ApniRide mobile application and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
The Service is a marketplace that lets drivers post inter-city trips and lets passengers find and book seats on those trips. We are not a transportation provider. We do not employ drivers. We do not own the vehicles. We are not a party to the trip itself; the agreement to travel is between the driver and the passenger.
We do not process payments. Drivers and passengers settle the fare directly between themselves using the payment methods displayed on the trip.
2. Eligibility
You must be at least 18 years old (or the legal age of majority in your jurisdiction) to create an account. By registering you confirm that you meet this requirement and that the information you provide is true and accurate.
3. Accounts
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that happens under your account.
- One person, one account. Sharing accounts is not permitted.
- You must provide accurate name, email, and (if you are a driver) vehicle details. Using fake names or impersonating others is grounds for suspension.
- You can delete your account at any time from inside the app. Deletion is immediate and irreversible.
4. Driver responsibilities
If you post trips as a driver, you represent and agree that:
- You hold a valid driver's licence required by the laws of Pakistan.
- The vehicle you use is registered, roadworthy, and covered by any insurance required by law.
- You will obey all traffic laws and not drive while impaired.
- You will only post trips you actually intend to drive. Cancelling repeatedly without good cause is grounds for suspension.
- You will treat passengers respectfully and not discriminate on the basis of race, religion, gender, disability, or any other protected characteristic.
- The fare you charge is your decision and your responsibility under applicable tax law.
- You will accept or reject seat requests in a timely manner.
5. Passenger responsibilities
If you book trips as a passenger, you agree that:
- You will arrive at the agreed pickup point on time. Repeated no-shows are grounds for suspension.
- You will pay the fare to the driver as agreed.
- You will treat the driver and other passengers respectfully and not discriminate.
- You will not bring weapons, illegal substances, or hazardous materials on the trip.
- You are responsible for your own belongings.
6. Conduct
You agree not to:
- Use the Service for anything illegal.
- Harass, threaten, or abuse other users.
- Post false, misleading, or fraudulent trips, requests, ratings, or reviews.
- Attempt to bypass safety features (e.g. by repeatedly creating new accounts after a ban).
- Reverse engineer, decompile, or scrape the Service.
- Interfere with or disrupt the operation of the Service.
We may suspend or terminate accounts that violate these rules without notice.
7. User content
You retain ownership of everything you post (trip listings, messages, ratings, photos). By posting, you grant us a worldwide, non-exclusive, royalty-free licence to host, display, and transmit that content for the purpose of operating the Service.
You are responsible for what you post. Don't post anything you don't have the right to share.
8. Ratings and reviews
After a completed trip, both parties may leave a rating and a written review for each other. Reviews must be honest and based on the actual trip. Fake or retaliatory reviews may be removed and the account suspended.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- The Service will be uninterrupted, secure, or error-free.
- Drivers or vehicles meet any particular standard.
- Passengers are who they claim to be.
- A trip will actually happen, will be on time, or will be safe.
You use the Service at your own risk. The trip itself is between the driver and the passenger. We are not responsible for the conduct of any user, on or off the Service. We do not screen, vet, or verify users beyond what is described in our Privacy Policy.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS (CURRENTLY ZERO) OR (B) USD 50.
Some jurisdictions do not allow these limitations; in those places they apply to the maximum extent permitted.
11. Indemnification
You agree to indemnify and hold us harmless from any claim, demand, loss, or damage (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of the rights of any third party.
12. Termination
You may stop using the Service at any time and delete your account from inside the app. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or pose a risk to other users.
13. Changes to the Service or Terms
We may modify the Service at any time. We may also update these Terms from time to time. When the changes are significant we will notify you in the app or by email. Continued use of the Service after changes constitutes acceptance of the new Terms.
14. Governing law and disputes
These Terms are governed by the laws of Pakistan without regard to conflict-of-laws principles. Any dispute arising under these Terms must be resolved in the courts of Lahore, Pakistan, and you consent to their exclusive jurisdiction.
15. Miscellaneous
- If any provision of these Terms is unenforceable, the rest remain in effect.
- Our failure to enforce any provision is not a waiver of that provision.
- These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service.
